Clarke Silverglate Wins Directed Verdict for Employer in Harassment Case

Clarke Silverglate’s client was sued by a former employee for sexual harassment under the Florida Civil Rights Act and retaliation under the Florida Whistleblower Act.  The former employee alleged that her male supervisor sent her a text message containing a naked photo of himself, propositioned her using sexually explicit language and massaged her shoulders.  She claimed that she reported the harassment and was subsequently terminated.  At the close of the plaintiff’s case, the court entered directed verdict for Clarke Silverglate’s client.  In a lengthy opinion, the court reasoned, among other things, that the alleged harassment was not sufficiently severe or pervasive to constitute actionable harassment.  The court also found insufficient proof that the plaintiff availed herself of the company’s preventive and corrective opportunities available to her or that her termination was causally related to a report of harassment.

Miami, Florida October 2011:  In September, Spencer Silverglate and David S. Weinstein, partners at Clarke Silverglate, P.A. in Miami, spoke at the Association of Corporate Counsel of America’s South Florida In-house Counsel Conference in Fort Lauderdale.  Mr. Silverglate presented a session entitled “Minimizing Exposure in a Wired World” that addressed a myriad of issues surrounding an increasingly connected workforce.  Mr. Weinstein presented a session entitled “The Foreign Corrupt Practices Act: How Can We Avoid Becoming One of DOJ’s Next Targets in Corporate America?” that addressed the increased focus of the Department of Justice upon Foreign Corrupt Practices Act investigations and how to implement an effective compliance program.
Earlier in the month Mr. Weinstein was the featured speaker at the Dade County Defense Bar Association’s latest installment in its Masters of the Courtroom Series.  Mr. Weinstein spoke about “Representation of the Corporate Client: Protecting the Individual as Well as the Corporation.”

David S. Weinstein joins Clarke Silverglate Law Firm

David S. Weinstein has joined the Brickell law firm of Clarke Silverglate, P.A. as a partner.
Mr. Weinstein brings to the firm 23 years of experience in criminal law, first as a state prosecutor, then a federal prosecutor, and most recently in private practice.  During his tenure as an Assistant United States Attorney, he served as the Chief of the Public Integrity/National Security and Narcotics Sections.  His courtroom experience includes over 100 jury trials in State and Federal Court.
Mr. Weinstein will head the firm’s white collar criminal defense practice.

March 2008 - Matthew K. Cordis has been named a partner of the Brickell law firm of Clarke Silverglate & Campbell, P.A..
